The rules for buyer to claim counterfeit have changed over the years, a lot, and back and forth.
Given this current story, near as I can tell, buyer is now expected to prove the stuff is fake, which can be nearly impossible. I don't expect it to stay that way, that's outrageous:

For the time being, describe a fake as being SNAD, but not exactly counterfeit.
