Emergency Shut Down function required.
Sometimes stuff does happen. Far more often, some seller complains that some emergency has blocked fulfillment to paying buyers. A proposal.
The Emergency Shut Down Button.
1. Immediately ends all current listings, no matter what.
2. Immediately refunds all payments received by seller but not shipped as yet.
3. Immediately blocks any further payment.
4. Blocks feedback/disputes on unpaid/refunded transactions.
Now, one more:
4. Immediately charges seller $100, which seller can choose among a list of charities to donate the money to. Seller is NOT refunded any listing or FVF fees.
The latter pretty well blocks abuse.
Seller can supply a reason, which is provided to inconvenienced buyers.
Ebay can provide additional monitoring to block abuse as appropriate.

Whither Griff?
It's been noted that Griff has not posted an "Ask Griff" thread since June.
However, Griff is still around. He has helped a lot of sellers deal with bureaucratic snafus in Ebay.
In particular, Griff has been useful in getting NPB negs removed, and getting add-counted multiple neg stars condensed into one.
I predict Griff's public statements were not working out, for two related reasons.
1. Griff was folksy, in a legalistic context.
2. Ebay doesn't want to publish commitments as to how they will handle situations.
It seems likely that sellers were calling CS, referencing an Ask Griff answer, and claiming that Griff promised them protection. Usually, the case was somewhat different than the case Griff had discussed, and sometimes it was totally different. However, the expectation that CS would track down what Griff had promised was causing internal stress.

Why allow a neg after buyer has lost a SNAD?
Here's an example.
Buyer buys a machine, which costs $75 for the machine, and $75 to ship.
The machine normally comes with a handle, which is shown in the picture.
When the machine arrives, the handle is just the wrong one, and doesn't work. When contacted, seller, smugly, agrees to take a return, with buyer paying return shipping. Delayed massive punishment with no warning.
I'm for improved seller performance, measured by DSRs, and coerced by ebay when necessary.
But this is just nonsense.
Seller has issues in July.
Come December, with no recent issues at all, seller ends up indefinitely suspended, with no warning.
I've read other similar stories.

Hey thanks for the replies. I totally understand the shipping and went back and even credited shipping cost to those I knew of. Of course, they already left the bad star , so they don't mention that. But the time period that I went through the slow shipping was back in july. EVERY single thing I have sold and shipped since then got great shipping time comments, but the gold star never acknowledged that and sat with less then half the star covered with gold. Even after I got the "Congratulations, you're improving" email, I sold more items with great shipping time and it still never budged. Then I got the Nov. 16th email saying I was back in the "doghouse: again with my DSR????
The latest is now I am BANNED from selling "indefinetely" as a result of the ratings. I called and customer servce actually transferred me to the "Safe Harbor" department , where a guy told me I was banned because of "customer complaints back in July".......JULY???? He also told me that when Ebay says indefinetely it means forever. I said "so basically you are putting me out of business for something I corrected that happened in July?"..he said yes. He would not tell me who or what any other complaints were, he told me they had not viewed my total feedback history, especially recently and the decision was made to ban me. SO I want to know how 279 sales with 100% positive and only 3 bad customer raps can Ebay justify a ban without a temp suspension or 30 day ban or something other then being done with you forever with no chance or place to appeal? This guy wouldn't even tell me the next level to go to to appeal./he said he was it. SO now I have to try and find a way to appeal this or start over with a new ID....how do you do that buy the way.....don't they catcvh it with your Paypal addy? Hey thanks for the help anyway. I spent the last 2 hours reading this forum and it is obvious I am not the only one being screwed by them

You can't make this stuff up
I gave a buyer positive feedback on an item I sold to him, but he gave me a neg because I said to him that I would rather donate the item to a charity then send it to him for the low price of $1.26
Yes I was a little up set but I did ship the item after calling him a low live.
This is a couple of months old now, do I have any recourse?

In this announcement we see:
Buyers prevented from opening cases too soon
Additional checks will be in place to ensure a reasonable window of time for delivery before a buyer can open an eBay Buyer Protection case for an item not received or item not as described. When you upload tracking information and delivery is confirmed, buyers will not be able to open a case for item not received.
However, we have seen several reports lately like this one:
I had one filed 2 weeks ago on a Monday after they paid on the Friday before.
I don't believe the promised protection is effective, or maybe there are some gotchas involving where the shipping label was purchased, or something else not explained very well.

Ebay removes neg for being unfair.
Not often we've seen such things in the past, who knows what the future will bring.
I have never had a negative feedback before and now I know how sellers feel when such a terrible thing happens. Ouch!!! It hurts!! I always send messages asking if everything was ok with there items when I havn't recieved a feedback. A month later after no response they leave you negative feedbacks claiming the problem is with the fact that the item turned out to be exactly what was in the description. Yes, it is unfortionately an ACEO 2.5"x3.5" print on 90lb cardstock. I had contacted ebay last night through a online chat and the person told me it would be best to call ebay during the call hours. So i had sent an email to the buyer which I don't think they check their messages because I had checked up on their order previously with no response. So I then posted this discussion as I was pretty steamed about it. I went to sleep and woke up with a message from customer support. So I did not need to try and call ebay afterall. Here is the message:

I have never had a negative feedback before and now I know how sellers feel when such a terrible thing happens. Ouch!!! It hurts!! I always send messages asking if everything was ok with there items when I havn't recieved a feedback. A month later after no response they leave you negative feedbacks claiming the problem is with the fact that the item turned out to be exactly what was in the description. Yes, it is unfortionately an ACEO 2.5"x3.5" print on 90lb cardstock. seller toysrus went live the other day with a huge number of listings. Could be related to their falling out with Amazon.
However, they seem to be plagued with inventory control issues.
Of their first 10 feedback, four mention non-performance.

EBay lawsuit reveals foibles of site feedback

When does a $2.33 transaction turn into a superior court case?
When it happens on eBay.
A dispute over a piece of smoky quartz normally would have been of little consequence to Kiel Sturm, who was selling the stone on eBay. But when a Los Angeles buyer made defamatory remarks that threatened to forever mar Sturm's online reputation, Sturm was forced to begin a yearlong legal battle to get the comments removed from eBay.
The squabble is another example of how user feedback on such sites can force ordinary people into time-consuming court proceedings to defend their reputations against remarks that can damage their business, because the comments remain online.
Even after Sturm obtained a court ruling stating that he had been defamed, eBay's lawyers continued to resist removing the remarks because the notice from small claims court was in the wrong format, forcing another round of court filings.
EBay has built itself into the world's largest online marketplace in large part because of trust created by feedback from users. Hoping to tap into the wisdom of crowds, Internet companies from Yahoo to YouTube are incorporating user reviews into their business models.
But a problem arises if a review is false. How does an Internet company separate unpleasant truths from defamatory lies? Most companies choose to let the courts decide.
Sturm, a 23-year-old computer programmer from Santa Clara, said he immediately offered to return Eusebio Guerrero's money after Guerrero told him he did not think the stone he bought was real. Sturm said Guerrero, who did not respond to an e-mail from the Mercury News, refused.
Powerful words
Sturm was in the middle of about 20 auctions when Guerrero left the first nasty note about him on an eBay feedback forum, on July 20, 2005.
``Not as advertised,'' the first note said. ``Absolutely misrepresented.'' The note was followed by a string of accusations, most of them written in capital letters.
``THIS SELLER CANNOT BE TRUSTED. HE SELLS JUNK. BUYERS MUST BEWARE OF THIS SELLER.''
Sturm felt the effect of Guerrero's remarks immediately, as buyers fled his auctions. A Colombian emerald that had been appraised for thousands of dollars ended up selling for $8.
Sturm said that he had enjoyed his hobby of buying and selling gems on eBay because many precious stones are undervalued. However, maintaining his reputation was crucial, he said, because buyers are afraid of counterfeits.
``People definitely check you out before they make a bid,'' Sturm said. ``If you have anything that looks suspicious, they are not going to bid or they are not going to bid very much.''
Integrity of feedback
Sellers can also check out buyers. But Sturm said he was running so many auctions he didn't check out feedback left about Guerrero, which might have raised a red flag, before he sold him the quartz and two other stones.
Afterward, it was too late. EBay will not remove feedback unless it receives a court order finding that the disputed feedback is ``slanderous, libelous, defamatory or otherwise illegal.''
Eric Goldman, director of the High Tech Law Institute at Santa Clara University, said such a policy is necessary to maintain the integrity of eBay's feedback system.
But in Sturm's case, eBay's goal of maintaining a reliable record through feedback of how transactions have gone had an unintended consequence: To clear his reputation, Sturm said he was forced into a string of lawsuits.
When Sturm filed against Guerrero in small claims court in Santa Clara County, Guerrero offered to settle, and both wrote letters to eBay requesting that the feedback be removed.
An eBay employee named ``Kelsee'' wrote back: ``Upon reviewing all correspondence regarding this request for feedback removal, a final decision has been rendered. The comment will not be removed. These removal policies have been made by our Legal Department and approved by eBay's management team.''
Sturm protested. ``I was hoping that if we submitted a request in writing, which we did, both of us, that eBay would see that as a valid reason to take down the comment,'' he said in an interview.
Next, ``Willie'' responded.
``Thank you for your e-mail regarding the status of your account,'' the note said. ``Your lawsuit, if it was against the other party, has no bearing on eBay's rules and policy. EBay is not involved in member disputes. We have thoroughly researched this case and are unable to remove the feedback without notice from a court of law. Since a final decision has been made, we will not revisit this case.''
Sturm told Guerrero he would file against him in small claims court in Los Angeles, where Guerrero lived, in order to get a written order. Sturm said he wanted to make the legal process easy for Guerrero.
On Jan. 31, small claims commissioner Graciela Freixes made a ``factual determination that the statements posted by the defendant on plaintiff's eBay site were defamatory.''
Sturm sent Freixes' order to eBay.
Try and try again
This time Francine F. Lyle, an eBay attorney, responded.
``There are too many ambiguities in this Order so I won't be able to use this to remove the comments,'' Lyle wrote. ``What I was looking for was an Order that you would have prepared and presented to the court (a proposed order), with the language I gave you, that the Court would then sign and enter.''
Sturm then filed a third suit directly against eBay in Santa Clara County Superior Court. Sturm argued that eBay was guilty of libel for publishing the defamatory remarks.
Generally, U.S. courts have found that Internet companies cannot be held liable for comments, ratings or reviews posted on their sites by users. The Communications Decency Act states that the provider of ``an interactive computer service'' will not be treated as a publisher of information provided by someone else.
EBay got the case dismissed on July 27.
But Sturm said he won anyway. About a week after he filed the lawsuit, eBay finally took down the feedback Guerrero had written. ``We went to the court and got a confirmation of the order,'' said Hani Durzy, an eBay spokesman. ``We didn't take it down because he sued us.''
``They made it very difficult, and there wasn't any reason to do that,'' Sturm said.
After five years of buying and selling on eBay, he said he now does most of his gem sales face to face.

Hello. I had a customer leave me bad feedback after threatening that she would if I did not make this transaction right by her. I offered her a full refund for the return, even though I had stated in my listing no returns, and offered to take care of any damages through UPS (which I had paid extra for, upgrading her package from parcel post to insured UPS). She did not want to return the item to me, nor did she want me to fill out a claim with UPS. She just wanted money. In an earlier email she had let me know that she was planning on giving me bad feedback.

I have reviewed the transaction and the email message you have exchanged with the buyer and I see that the buyer was not happy because there was a missing part on the item.

Two key questions regarding the new feedback extortion policy
1. If buyer is judged to have used feedback extortion, will any neg left be removed always, sometimes, or never? If buyer posts positive with negative stars, will those stars be removed always, sometimes, or never?
2. If buyer posts negative feedback, and replies to an inquiry by seller with an offer to make peace and revise the negative in exchange for a partial refund, will that be considered feedback extortion?
Neither of those questions are answered by the new feedback extortion page.

There are a number of systematic checks in place that may prevent an eBay Buyer Protection or PayPal Buyer Protection case from being opened. If a buyer tries to open a case with you, but it doesn't pass our checks, a case won't be opened and would not be considered in your seller performance evaluation. We make sure that:
The transaction is eligible for eBay Buyer Protection or PayPal Buyer Protection.
The buyer has paid for the item.
The buyer hasn't already received a full refund via PayPal.
A case hasn't already been opened for the same transaction (this includes cases under eBay Buyer Protection, PayPal Buyer Protection, or Vehicle Purchase Protection).
Enough time has passed from payment to when a buyer tries to open a case. A case cannot be opened until:
3 days past estimated delivery date when a buyer claims an item wasn't received
Enough time has passed for an item to have arrived when a buyer claims an item doesn't match the listing description
If a case passes the initial checks, but we later discover one of the above scenarios, the case won't be considered in your seller performance evaluation.
Cases that may be removed
Once a case is opened, it will usually be considered part of a seller's performance evaluation. A case will only be removed from consideration in rare situations. Both open cases and cases closed without seller resolution can affect a seller's performance evaluation. Understanding the Seller Dashboard provides detailed information on how cases affect seller status.
Cases with any of the following scenarios will be automatically removed:
Cases that have been escalated and closed in the seller's favor or no one is found at fault.
Cases opened as a result of fraudulent activity.

Auctiva has gone rogue, spamming buyers. Sellers beware.
Auctiva, over the past month or so, has converted itself into a spamming rogue. One might guess they're on the way down, and desperately trying to make money spamming to stay alive.
Sellers who use Auctiva to create listings are, by default, granting Auctiva the right to spam their buyers. While this has been true for some time, only since about September have we seen the massive spamming which identifies Auctiva as the enemy of their sellers.
The nature of the spam identifies seller as having selected buyer for extended protection, a service called "buyshield".
Buyshield spam first started in March, 2009, as I can see, but it seems to have been suppressed for a while.
Sellers universally report that they know nothing about it, but an inspection of the Auctiva agreement shows that use of Auctiva indeed grants this right to Auctiva.
In theory, seller can opt out of this program. But Auctiva can start new spam campaigns at will, and seller might not even know about the new one or the expectation to opt out of that one too.

Ebay restricts a shipping gouger

Get a load of this. I have been on eBay for 11 years and have over 4400 in positive feedback with "0" negatives. Because of the DSR system eBay has restricted me from selling on eBay.
I am not the largest seller on eBay and do this out of my home. I have not changed anything I have done in 11 years.
The reason is of the low DSR rating in shipping in handling. I sell mostly sporst cards and my shipping an handling charge is $3.95. That may seem like a lot to some but I did a cost breakdown and my actual shipping and handling cost are from $3.60-$4.35.
I factored in postage with delivery confirmation ( which eBay requires for seller protection), bubble wrapped envelope, snap tites for the cards, mailing labels, extra packaging, tape, printer ink and $0.75 for handling fee which covers time spent on listing the item packaging it, delivery to post office. In most cases when a card sells for only $0.99 I am close to losing money after all the fees taken out.
Because of 21 low S/H in a year...eBay has restricted me. All my other DSR are 4.94 or higher.
No get this, if a buyer buys 5 items from a seller and leaves 5 positive feedback, a seller is credited for 1 positive. If that same seller likes everything but your S/H and leaves you 5 1's or 2's you are charged for all 5. When eBay thinks you have too many, they restrict you.
I am only allowed to sell $134 a week right now...GREAT TIMING eBay..with the hoildays coming up you are restricting one of the most dedicated and best selling sellers on eBay.
Observations:
1. It doesn't cost $3.60 to ship a sports card.
2. Hooray for ebay.

Selling hope
The theory is that a buyer will pay a bit more.
It often yields undesired feedback, and/or a losing SNAD dispute.
Often, the hope includes a question mark.
Gold?
Tiffany?
The technical analysis shows this to be lacking insight. If the stuff really is gold, then surely it would sell for far more being described as gold. If the stuff is brass instead, then what did buyer get for his money, and why would buyer be happy about that?

The ultimate dumb move: refuse the returned package
From time to time, some poorly informed poster on the board will advise a seller facing a return to refuse the package.
While one's intuition might yield that advice, it's dead wrong. Refusing a return is near certain to result in no stuff and no money. The exceptions involve buyer cooperation.
I started by trying to help this person with a partial refund but he refused and escalated the claim. Afterwords the initial Paypal ruling landed in my favor, he tried to return the expensive item anyways using UPS, I refused to accept it for legal reasons and it was sent back to him in another state.
After he got the item back, he called his CC company to perform a chargeback against me. It worked.
Paypal said they couldn't/wouldn't help me. The buyer kept the merchandise and got a full refund for over $1000.

The concept of timely shippng.

I recently had my account limited becasue of too many dsl 1's and 2's on my shpping time on my auctions.
Here's my question.
On ALL my auctions, I used the "ten day handling" time that ebays offers to sellers..for a reason.
So, why or how can I be punished for using what is offered to me?
When ebayers buy my items, it's right there in the listing..and they still buy and pay. Just because they don't get it in a cpl of days they leave a low dsl...but ebay provides that time period???????????
And the answer is, you can't tell people you intend to treat them poorly, and expect them to be happy when you treated them poorly, because you warned them.
Perhaps the related answer is: ebay sellers will be judged against other ebay sellers, and not judged against their feeble promises.

Free Shipping (but really postage due).
We've now seen multiple reports of this scam. It seems to be growing now that free shipping yields no s/h star. Buyers are having a hard time figuring out which star to leave the 1 on.
It's usually minor, a buck or so. Seller ships the stuff for free, resulting in various benefits not the least of which is more sales.
But when the stuff comes, shipping turns out to not be so free. Postage due.
So long as buyers fail to post sincere feedback in such cases, we can expect to see them increase.

Top Ten Traps for New Ebay Sellers
Over time, we've seen some common disasters encountered by new sellers who didn't realize the Ebay way.
Generally, an Ebay disaster means establishing a bad ebay record. A seller who screws up is seldom vulnerable to being sued, or anything more than that.
The top ten traps:
1. If some other seller is doing it, then it must be ok. Lots of listings on Ebay violate Ebay rules, and will be removed if reported. Even more contain statements which if seller did what the statement says, seller would almost certainly come to some bad result.
Shipping gouge (seller trying to profit from shipping).
Shipping to be calculated after end of auction.
Shipping insurance to be added separately.
Shipping insurance decision to be left to buyer (insurance benefits seller, not buyer)
"Free shipping", which is actually local pickup only.
Can't buy item unless buyer buys something else outside of the listing, like a cell phone contract.
"As Is", or "No returns accepted".
Add on items offered separately.
2. Doing it my way. Sellers who insist on doing it the way they think best eventually come to some painful end. Understand that Ebay holds some very powerful cards, and can mechanically trump seller's intent. For example, seller must understand the Ebay way regarding return requests. "Do I have to accept a return"? The written rules suggest not, and seller can put "no returns accepted" in the listing, but the reality is that if buyer files a well formed complaint, seller does have to accept stuff back for a refund including 1st way shipping. A seller who refuses to pay return shipping can expect to get very bad feedback scores.
3. Failing to figure out proper shipping before creating a listing. Usually, there is one best way to ship a particular thing, and that is the only way which should be offered. Don't let your buyer make a mistake, because you will pay. For sure don't force your buyer into a sub-optimal shipping method. Understand:
USPS Priority Mail Flat Rate Boxes. Three size categories, almost always right for smaller, heavier stuff.
First Class Package (under 13oz, goes just as fast as Priority Mail)
Parcel Post (never indicated under about $8 because there is a better choice, but as stuff gets larger and heavier, it's usually the right choice over $10.
UPS Ground (a competitor to Parcel Post, but it just won't work out to use the UPS storefronts to package and ship, because they are too expensive).
International Shipping. Most affordable international shipping methods do NOT meet the requirements for Paypal seller protection. Seller needs to be comfortable with that, but also realize that some countries have far more losses than others. Italy in particular should probably be avoided.
Understand Paypal Seller Protection rules: ship within 7 days, ship with Delivery Confirmation under $250 (including shipping), and with Signature Confirmation over $250, and ship to the address provided by paypal.
4. Impatience regarding being paid. Don't expect to see your money for the best part of a month as a new seller on Ebay, and you'll not be disappointed. It's a big mistake to put aggressive payment demands in the listing and follow them up with harassment of a slow paying buyer. Buyers can sting. Don't miss the "21 day hold". To block seller scams involving collecting the money and running, Ebay/Paypal hold seller funds for 21 days. They do release the funds earlier when seller can show delivery confirmation (DC) and requests the release. They also release funds earlier when buyer posts positive feedback.
Don't ask buyer for feedback so seller can get paid. Buyers misunderstand the 21 day hold thing far more broadly than new sellers, and often interpret such requests as indicating a scam. Do not ever ask buyer for feedback, because the feedback you get might be tainted by the request.
5. Drop Shipping. Drop shipping is when seller accepts the order but submits it to some warehouse which actually ships the stuff to buyer. The problem here is that seller takes all the heat when stuff goes wrong, and stuff goes wrong regularly. Ask yourself: why does this outfit need me? Why can't they list stuff themselves? The answer is, they need someone in between to absorb issues like Out Of Stock. Out Of Stock on Ebay is a major seller infraction and Ebay encourages buyers to penalize such sellers with unhappy feedback. Buyer is not buying a refund, and feels a loss when the stuff is not delivered.
6. Imagining that the written listing will provide protection against buyer confusion. If buyer is confused, seller loses. Particularly when bad news is buried down in the small print. If buyer is disappointed in what comes, buyer can almost certainly return it for a full refund. In particular, avoid:
Ask questions first. (confused buyers don't feel confused at all)
As shown in pictures (but when the picture shows some defect not otherwise disclosed, expect a bad result)
Ambiguous size. (you know what size it is, buyer knows what size it is too, but the two of those can be wildly at odds with it not being figured out until buyer receives what seems to be a tiny package).
Selling junk described pretty much as junk. (buyers will hope for something above the junk level, seller loses. Throw the junk in the trash, or donate it to your favorite charity thrift)
Not blocking buyer from international places seller does not wish to ship to. Configuring only USA shipping is not at all the same as formally stating that seller will ship only to the USA, and international bids are accepted. There is a block which must be configured on seller's selling profile.
7. Shipping gouges. Yes, some sellers are shipping gougers. No, it won't work for a new seller. Don't see shipping as a profit, and don't imagine that buyer will be pleased to aid you in avoiding ebay fees.
8. Canceling a transaction. It's tempting, after determining that buyer might be problematic, to want out of a transaction. Canceling a transaction on Ebay is not defined like new sellers might imagine. Canceling requires buyer's agreement, and does not compromise buyer's rights to leave feedback. Don't cancel unless you have some reason to expect buyer will cooperate. Generally, if buyer has neither paid nor communicated, it is far better to file the Unpaid Item Dispute. If buyer has paid, it is almost never appropriate to refuse to ship the stuff and try to cancel instead.
9. When seller lists an item, seller is required to actually sell it at the price it brings. If in doubt, look up prior sales to see what this kind of thing will bring in an ebay auction. Do not consider unsold listings as showing value, rather they show some kind of ceiling. Understand "commodity demand" vs "sparse demand". Commodity demand items attract attention and will sell around the commodity price if listed correctly. Sparse demand items might find a qualified buyer once a month, and thus are inappropriate for low starting price auctions.
Listings can generally be ended earlier than 12 hours before close with no commitment to anyone.
Watch out for:
Selling things for friends/relatives (who sometimes refuse to complete the sale)
Allowing other people to make decisions about stuff you have listed (such as selling it to someone else, or donating it to a charity)
Listing stuff which you don't actually have as yet (and may never get).
